Service: Jewelry Studio PWA (jewelry design generation platform)

1. Agreement

By accessing and using Jewelry Studio ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these terms, do not use the Service.

2. Service Description

Jewelry Studio is an AI-powered jewelry design generation platform. You can:

  • Create design runs and generate photorealistic jewelry designs
  • Generate 3D models of designs using Meshy API
  • Build and price drops for manufacturing
  • Manage designs and export files

3. Eligibility

  • You must be at least 18 years old
  • You must have a valid payment method on file for paid plans (free tier does not require payment)
  • You must not be located in sanctioned jurisdictions (OFAC)
  • You must not violate any applicable laws

4. Account Responsibility

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Promptly notifying us of unauthorized access (Ryan@RyanB.NYC)

We are not liable for unauthorized access if you fail to maintain account security.

5. No Refunds Policy

All sales are final. Once you submit a design generation request and payment is processed, the designs are immediately generated and delivered to your account.

Because designs are instantly consumed and cannot be reversed, we do not offer refunds for any reason, including:

  • Failed or unsatisfactory generations
  • User error or scope changes
  • Change of mind
  • Accidental purchases

6. Acceptable Use

You agree NOT to:

  • Generate designs depicting violence, hate, explicit sexual content, or illegal activity
  • Infringe on intellectual property rights (copyrights, trademarks, patents)
  • Resell, sublicense, or redistribute the Service or its underlying technology
  • Reverse engineer or scrape the Service
  • Harass or harm other users
  • Violate any applicable laws

We reserve the right to remove content and terminate accounts that violate these terms.

7. Intellectual Property

  • Your Designs: You own the designs you generate, subject to limitations below
  • Limitations: Designs containing copyrighted materials, trademarks, or likenesses you don't own or have permission for may infringe third-party rights. You are solely responsible for ensuring your designs don't violate IP laws.
  • Service IP: Jewelry Studio, its logo, and all Service materials are our intellectual property
  • Feedback: Any feedback you provide is non-confidential and we may use it without compensation

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We provide the Service "AS IS" without warranties of any kind
  • We are not liable for indirect, incidental, special, or consequential damages
  • Our total liability is limited to the amount you paid in the last 30 days (minimum $0)
  • Some jurisdictions don't allow liability limitations, so this may not apply to you

9. Indemnification

You agree to defend, indemnify, and hold harmless Jewelry Studio from any claims arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your designs or content
  • Your infringement of third-party rights

10. Dispute Resolution & Governing Law

These Terms are governed by the laws of New York, without regard to conflicts of law.

Jurisdiction: Any legal action or proceeding related to these Terms shall be brought exclusively in the courts of New York County, New York, and you irrevocably consent to such jurisdiction.

Informal Resolution First: Before filing any lawsuit, you agree to contact us at Ryan@RyanB.NYC to attempt to resolve the dispute informally.

11. Termination

We may terminate your account at any time for:

  • Violation of these Terms
  • Illegal activity
  • Inactivity for 12+ months
  • Business discontinuation

Upon termination, your access is immediately revoked but stored designs remain accessible for 30 days.

12. Modifications to Service

We reserve the right to:

  • Modify or discontinue the Service at any time
  • Change pricing with 30 days' notice
  • Change these Terms with 30 days' notice

Continued use of the Service after modifications constitutes acceptance.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted or error-free
  • Results will meet your expectations
  • Generated designs will be suitable for manufacturing
  • 3D models will be accurate or usable

15. Severability
